MED Academy Terms of Use
Welcome to MED Academy. Please read Terms of Use and Privacy Policy prior to registering to MED Academy. These terms of use bind you or the institution that you represent to the terms and conditions contained in this document. By using our site, you accept and agree to be legally bound by these agreements. Please do not use the site if you do not understand or wish to be legally bound by these terms and agreements.
MED Academy reserves the right to change the Terms of Service at any time without advance notice. Changes will be effective immediately upon posting at the MED Academy site.
Med Academy provides medical and non-medical courses for doctors and other health care providers. We offer an alternative option for learning by offering courses that you can access at your own time, place and pace.
By using the MED Academy site, you agree that you are responsible for your own use and for your own postings. You also agree that use of the site should be in accordance to Terms of Agreement and applicable national and international laws.
Content that harasses or threatens others, discusses illegal activities, infringes in the intellectual property of another person or institution, indecent or unlawful content are prohibited. Posting software that may damage another computer or property is not allowed.
Downloading any site content without the permission of the authors or the MED Academy Admin is also strictly prohibited.
In order to gain full access to MED Academy site, you will be required to provide your name, email address and user password. You may be asked to provide other optional information in setting up your account. You agree that all information that will be provided will be accurate at all times.
You must also inform MED Academy if there is any unauthorized access to your account or breach in security to your account. If you fail to comply, MED Academy will not be responsible to any loss or damage to your account. MED Academy will not be liable to any changes or damages done prior to notifying us.
Transfer of account to another person or using another person’s account is not allowed.
MED Academy instructors agree to be bound by the Memorandum of Agreement with MED Academy prior to providing learning services.
Other responsibilities of Instructors
Pricing of MED Academy courses is in accordance to industry standard and instructor terms. Student who purchase a course agree to pay the corresponding fees set for that particular course.
All payments are made to MED Academy. By purchasing courses, students confirm that they want the course to be immediately credited to their account. Courses will be credited to a student’s account once payment confirmation has been received from our payment gateway.
Subscription based modules, are modules that run for a period of 3 months of more. Students are billed for subscription based modules on a monthly basis.
Cancellation of subscription based modules can be done via the contact us section. A student who cancels subscription will not be billed during the next billing month.
All cancellation requests are subject to approval of MED Academy Admin. If your cancellation request is approved, we will notify you and discontinue billing to your credit card or your original method of payment.
MED Academy reserves the right to update, change, delete, terminate, suspend any submitted content or courses. We also reserve the right to terminate your access to our services or your account if you violate our terms and conditions and applicable policies.
MED Academy reserves the right to suspend, disable or terminate content or accounts of users that infringe upon copyrights, trademarks and intellectual properties of others.
MED ACADEMY OR ANY OF OUR SUBSIDIARIES, AFFILIATES, LICENSORS, SUPPLIERS,
ADVERTISERS OR SPONSORS, NOR ITS DIRECTORS, OFFICERS, EMPLOYEES,
CONSULTANTS, AGENTS OR OTHER REPRESENTATIVES, ARE RESPONSIBLE OR LIABLE
FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR
OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF
BUSINESS, LOSS OF DATA OR LOST PROFITS), UNDER ANY CONTRACT, NEGLIGENCE,
STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY TO
THE SERVICES AND/OR MATERIALS, INCLUDING ANY MATERIALS AVAILABLE THROUGH
ANY THIRD PARTY PLATFORM, SUBMISSIONS, ANY LINKED WEBSITES OR ANY CODE,
PRODUCT OR SERVICE PURCHASED, ACCESSIBLE OR USABLE THROUGH THE
SERVICES OR ANY THIRD PARTY PLATFORM. YOUR SOLE REMEDY FOR
DISSATISFACTION WITH THE SERVICES, MATERIALS, INCLUDING ANY PRODUCTS OR
SERVICES AVAILABLE THROUGH ANY THIRD PARTY PLATFORM, SUBMISSIONS OR ANY
LINKED WEBSITES IS TO STOP USING THE SERVICES, MATERIALS, SUBMISSIONS,
PRODUCTS, OR LINKED WEBSITES, AS APPLICABLE. THE SOLE AND EXCLUSIVE
MAXIMUM LIABILITY TO MED ACADEMY FOR ALL DAMAGES, LOSSES AND CAUSES OF
ACTION, WHETHER IN CONTRACT, TORT (INCLUDING WITHOUT LIMITATION,
NEGLIGENCE) OR OTHERWISE, SHALL BE THE TOTAL AMOUNT PAID BY YOU TO MED
ACADEMY IN THE PRECEDING TWELVE (12) MONTHS, IF ANY, TO ACCESS OR USE THE
SERVICES. NO COMMUNICATION OF ANY KIND BETWEEN YOU AND MED ACADEMY OR
A REPRESENTATIVE OF MED ACADEMY CONSTITUTES A WAIVER OF ANY LIMITATIONS
OF LIABILITY HEREUNDER OR CREATE ANY ADDITIONAL WARRANTY NOT EXPRESSLY
STATED IN THE TERMS. MULTIPLE CLAIMS WILL NOT INCREASE THE MONETARY
DAMAGES LIMIT STATED HEREIN. YOU AGREE THAT THE DAMAGE EXCLUSIONS IN
THESE TERMS OF USE SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
You hereby indemnify, defend and hold harmless MED Academy, and its affiliates, officers, directors, agents, partners, employees, licensors, representatives and third party providers from and against all reasonably foreseeable losses, expenses, damages, costs, claims and demands, including reasonable attorneys’ fees and related costs and expenses, due to or arising out of Your breach of any representation or warranty hereunder. We reserve the right, at Our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You under this Section 14, and in such case, You agree to fully cooperate as reasonably required with such defense and in asserting any available defenses.
